Terms and Conditions

Intellectual Property Notice

The artist retains all copyright. Copyright to the images of all artworks created and sold by Amanda van Gils remains the sole property of Amanda van Gils including after purchase. 

The purchase of any item, original or otherwise, does not grant the customer permission to use, reproduce or distribute images of the artwork in any form, by means of profit and/or otherwise. Nor may the customer assign any rights to others to do the same.

Owners may post images on social media without breaching this clause. Please credit the artist when sharing images of her work.

Amanda van Gils may use images for other purposes, whether the original artwork has been purchased, or not.

Amanda is a member of the Copyright Agency who can assist with requests for licensing of images.

Liability

While I take care to always use high-quality, professional archival materials in the creation of my artwork, I am not liable for goods once they are in the possession of the purchaser. It is not my duty to refund, exchange, repair, replace or compensate by any means for the damage of artworks once received by customers. 


As guaranteed under consumer protections, compensation for damage is due if/when damaged products are received when impacted by postal services and/or faulty merchandise has been dispatched. Every artwork is inspected several times before clearing quality control for shipment and only pristine purchased artworks are packaged for you to enjoy.

Please read the product descriptions thoroughly and carefully and contact me with any questions you may have prior to purchase. It is not our duty to compensate customers who do not read the information provided in the product description before purchase. 

Shipping Policy

Do you ship worldwide?

  • Yes, I do! 
  • All deliveries include Insurance, Signature on Delivery and Tracking.

What are the shipping costs?

Australia:
For Australian purchases, shipping is added to the cart based on the size of the artwork you have selected.
Shipping costs within Australia are subsidised by the Artist. The current costs, irrespective of your location in Australia, are Small $10, Medium $50, and Large $100 per item.

My studio is located in Brisbane, Queensland and Local Pick Up may be available by appointment only. Local Pick Up is at no cost.

International:
Please contact mail@amandavangils.com and provide your shipping location. Shipping will be calculated based on your location and a quote will be provided.

 What if I have provided an incorrect address?

If you need a change of address, I must be alerted within 24 hours of purchase to guarantee a redirect. Unfortunately, if your purchase has already been dispatched, we are unable to change the address. 

Amanda van Gils is not responsible for undelivered packages based on incorrect shipping addresses given by the customer. Please ensure that you provide the complete and correct mailing addresses at the checkout.

Please contact me via email or through the contact page as soon as possible. 

Duties and taxes

For purchases within Australia, GST is included in the price shown.

For purchases internationally, my studio is not liable for import fees on any items purchased. Any applicable taxes and duties for international orders are not included in the checkout total. 

These are determined by the customs agency in the destination country. Some countries charge import taxes while others do not. The customs agency will notify the recipient either by mail, phone, or email to pay these charges so the shipment can continue to its destination. 

It is the responsibility of the customer to pay any duties, value added tax or other similar charges. If you refuse to pay these additional amounts, your delivery will be returned to us. Provided that the product is in its original condition, we will refund you the cost of your purchase.

Items are declared at purchase value for exporting and under no circumstance will documents be falsified.

Refund and Returns Policy for Amanda van Gils

At Amanda van Gils, we are committed to ensuring your satisfaction with your purchase. If something has gone wrong, or your item wasn’t as expected, we will do everything we can to make it right.

  1. Faulty or Damaged Goods

If you receive a faulty or damaged item, please contact us immediately at mail@amandavangils.com. Under Australia’s consumer protection laws, we will cover the return shipping costs for faulty merchandise or products not covered under the consumer guarantee.

  1. Change of Mind Exchanges

You may exchange your item within 14 days of receiving your order if you change your mind. To be eligible for an exchange:

  • The item must be unused and in the same condition that you received it.
  • It must be returned in its original packaging.

Full exchanges will only be granted if the artwork is returned in its original condition. Please note that:

  • You will be responsible for paying your own shipping costs for returning your item.
  • Shipping costs are non-refundable.
  1. Return Process

To initiate a return, please follow these steps:

  1. Contact us at mail@amandavangils.com to advise of your exchange request and to receive further instructions.
  2. Use a trackable shipping service to return your item to ensure it can be tracked. We do not guarantee that we will receive your returned item.
  1. Timeframe for Refunds

Our refund and returns policy lasts for 14 days. If 14 days have passed since your purchase, we cannot offer you an exchange.

Upon receiving and inspecting your returned item, we will notify you of the approval or rejection of your exchange. If approved, your exchange will be processed, and the new item will be shipped to you.

  1. Photography and Colour Accuracy

We strive to offer colour-accurate photography of the artwork. However, please be mindful that colour calibrations can vary between devices. If colour accuracy is a concern, we recommend viewing the item from multiple devices (desktop, smartphone, etc.) before making a purchase.
